Software license
This is a non-exclusive LIMITED LICENSE from
CommuniConsultants, Inc. d/b/a WitsEnds Software ("WitsEnds
Software") granting you ("Purchaser") a license
to use the software program ("Product") you are purchasing
and/or downloading subject to the following:
Limited license
WitsEnds Software hereby grants Purchaser a non-exclusive
limited license to install and use one copy of Product on a single
personal computer. If a network version of Product was purchased,
the limited license shall extend to concurrent use of no more
than the number of copies purchased. Purchaser may transfer Product
and accompanying written materials to another user on a permanent
basis provided Purchaser retains no copies and the recipient agrees
to the terms of this license agreement. Any reproduction or redistribution
of the product not in accordance with the License Agreement is
expressly prohibited by law, and may result in severe civil and
criminal penalties.
Copyright and proprietary
information
Product and all accompanying written materials, if any, constitute
valuable property of WitsEnds Software and all title and ownership
rights in Product and related materials remain exclusively with
WitsEnds Software. WitsEndsbSoftware reserves applicable laws
for the protection of proprietary information, including, but
not limited to, trade secrets, copyrights, trademarks and patents.
Purchaser may not cause or permit Product to be reverse engineered,
decompiled, disassembled, marketed, distributed, sold or licensed
or cause or permit the creation of derivative programs. Purchaser
may duplicate Product only for back-up or archival purposes of
Purchaser, and shall not cause or permit any other copying, reproduction
or disclosure of any portion of product or any accompanying documentation
or the delivery or distribution of any part thereof to any third
person or entity, for any purpose whatsoever.
Limited warranty
WitsEnds Software warrants to Purchaser that Product will perform
substantially in accordance with the accompanying written materials,
if any, under normal use and service. WitsEnds Software's entire
liability related to Product and Purchaser's exclusive remedy
shall be replacement of Purchaser's copy of Product. Such replacement
must be substantiated to WitsEnds Software within one year of
purchase. This limited warranty shall not apply if failure of
Product has resulted from accident, abuse, misuse or misapplication.
This limited warranty is not available outside the United States.
ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING,
BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.
No liability for damages
WitsEnds Software and its suppliers, successors and assigns
shall not be liable for any damages whatsoever, including without
limitation, special, indirect or consequential damages for loss
of business revenues or profits, loss of business interaction,
loss of information, or other injury or pecuniary loss arising
out of the use or inability to use Product, even if WitsEnds Software
has been advised of the possibility of such damages.
